Terms of Service

1. Agreement to these terms
These Terms of Service form an agreement between you and Summis for use of trysummis.com and related services. By creating an account, purchasing a plan, or using the service, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, do not use Summis.
If you accept these terms for a student or another person, you represent that you have legal authority to do so and to provide that person's information.
2. Age and guardian requirements
Summis is not available to children under 13. You may not create an account for, allow use by, or submit personal information about a child under 13.
If you are at least 13 but under 18, your parent or legal guardian must review and agree to these terms and our Privacy Policy and consent to your use of Summis. If you are a parent or guardian, you are responsible for the minor's use of the service and for ensuring that submitted information is appropriate and accurate.
3. What Summis provides
Summis provides tools for student profiles, college application planning, AI-generated admissions strategy, reports, recommendations, essay angles, and related educational guidance. Features may change as we improve the service.
Summis is independent. It is not a school, admissions office, licensed school counselor, legal adviser, or financial adviser, and it is not endorsed by any college unless we say so expressly in writing.
4. AI and admissions limitations
Some outputs are generated with artificial intelligence and may be incomplete, inaccurate, outdated, or unsuitable for a particular student. You must review important facts, deadlines, requirements, recommendations, and essay ideas before relying on or using them. Official college sources control when they differ from Summis.
Summis does not guarantee admission, scholarship eligibility, financial aid, or any other outcome. College decisions are made solely by the relevant institutions.
You remain responsible for application content and submissions. Summis does not access or submit through a student's college application portal.
5. Your account and information
- Provide accurate account, age, guardian, profile, and payment information.
- Keep credentials confidential and use a unique password.
- Notify us promptly if you suspect unauthorized access.
- Only submit another person's information with proper authority and consent.
- Do not upload information that is not reasonably needed for college strategy.
You retain ownership of information and content you submit. You grant Summis a limited, nonexclusive license to host, process, reproduce, and disclose that content only as needed to operate, secure, support, and improve the service as described in the Privacy Policy.
6. Acceptable use
You may not:
- Use Summis for an unlawful, fraudulent, deceptive, or harmful purpose.
- Submit information about a child under 13.
- Impersonate another person or misrepresent authority, age, or guardian consent.
- Attempt to access another user's account, profile, report, or application data.
- Probe, bypass, disable, or interfere with security, rate limits, or access controls.
- Use bots, scraping, or automated extraction except with our written permission.
- Upload malware or content that infringes another person's rights.
- Use outputs to make a legally significant decision about another person.
- Resell or commercially redistribute the service or generated reports without permission.
7. Plans, billing, and refunds
Prices, plan duration, included features, and renewal terms are shown at checkout. Stripe processes payments. You authorize the displayed charge and, for a recurring plan, charges at each renewal until cancellation.
Unless checkout states otherwise, you may request a refund within seven days of purchase if no full strategy report has been generated under the purchase. After a report is generated, refunds are discretionary except where law requires one. Taxes and third-party payment fees may apply.
You can manage a recurring subscription through the billing portal. Deleting an account ends access and cancels active subscriptions associated with that account. Account deletion does not by itself create a refund.
8. Our intellectual property
Summis and its licensors own the service, software, prompts, visual design, methods, trademarks, and report presentation, excluding content you submit. We give you a limited, revocable, nontransferable right to use the service and your generated report for personal, noncommercial college-planning purposes while your account is authorized.
Feedback may be used without restriction or compensation, but we will not identify you as its source without permission.
9. Suspension and termination
You may stop using Summis or delete your account at any time. We may suspend or terminate access when we reasonably believe these terms were violated, an account presents a security or legal risk, payment is overdue, or law requires it. When practical, we will provide notice and a chance to address the issue.
Sections that by their nature should survive termination remain effective, including ownership, payment obligations already incurred, disclaimers, limits on liability, and dispute terms.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMIS IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY OUTPUT WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR CURRENT.
Some jurisdictions do not allow certain warranty exclusions. In that case, the exclusions apply only to the extent permitted by law. These terms do not waive rights that cannot lawfully be waived, including rights held by minors or consumers.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMIS AND ITS OWNERS, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST OPPORTUNITIES, PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMIS'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID SUMMIS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnity
To the extent permitted by law, you will defend and indemnify Summis from third-party claims, losses, and reasonable costs arising from your unlawful use of the service, content you submit, or a material violation of these terms. This section does not apply where prohibited by law and does not require a minor to assume obligations they cannot legally assume.
13. Governing law and disputes
California law governs these terms without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. State and federal courts located in California will have jurisdiction over disputes, unless applicable law gives you the right to bring a claim elsewhere.
Before filing a claim, please email a description of the dispute and requested resolution. Both sides agree to make a good-faith effort to resolve it informally for 30 days. This does not prevent either side from seeking urgent injunctive relief or using small-claims court.
14. Changes and general terms
We may update these terms as the service or law changes. We will post the new effective date and provide additional notice for material changes. Continued use after the effective date means you accept the updated terms, to the extent permitted by law. If you do not agree, stop using the service and delete the account before the changes take effect.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer these terms without our consent. We may transfer them as part of a merger, reorganization, financing, or sale of the service.
